When you use Klaviss Technologies Corp., a Delaware corporation, and/or its affiliated companies (collectively, “Klaviss”, “us”, “we” or “our”), services to find, list, buy or sell your property, get a mortgage, or connect to a real estate professional, we know you’re trusting us with your data. We also know we have a responsibility to respect your privacy, and we work hard to do just that. This policy explains what information we collect, why we use it, who we share it with, and how we protect it, along with the tools you can use to manage your privacy.

Information Collected by Klaviss

When you use our services, we collect a variety of information from and about you and your devices. Some of this information identifies you directly (like an email address) while some of it is associated with you through your account, profile, or device (like the properties you choose to save or your location data).

The kind of data we collect about you depends on how you use Klaviss. Even if you don’t have an account with us, we may still collect some data about you, like your email address and phone number if you choose to contact a real estate agent through our platform, or your IP address and other device information when you browse our sites or use our apps.

Without limiting anything in this privacy policy, the information we collect may include: Categories of information you may provide to us include:

  • Your name, address, phone number, and e-mail address;
  • Your account log-in details;
  • Photos, videos, disclosures and any other information relating to your property or your past, current or potential property listings (including metadata in the file);
  • Circumstances related to your purchase or sale of your property;
  • Properties you visit or view on our website or mobile application and your opinions about those properties;
  • Reviews or comments you leave on our website, mobile application, or other public websites;
  • Your driver’s license or state ID information;
  • Real estate offer letters, agreements, waivers, addendums, amendments, disclosures or any other documents uploaded, accessed through or by, or created by, with or using our platform;
  • Information related to your financial ability to buy a property;
  • Citizenship status (for tax calculation purposes); and
  • Marital status (for tax calculation purposes).

Information You Give Us or Create Using Our Services

When you use our services, we often ask you about your data. These usually include basic things like your name, email address, and phone number. If you use our transaction services, we might ask you for more sensitive data like your income, housing history, and credit score. If you contribute information, such as agent reviews, we’ll store that too.

You may also provide information about other people through our services. For example, if you share a property listing with someone, we will collect that person’s email address as part of your account information.

Information from Public Sources and Third Parties

Klaviss collects information from public sources, such as county and state tax and property records, government agencies, and multiple listing services (“MLS”). Most of this information is about properties rather than people, but some information we collect, like the identity of a property’s owner or real estate license information, may relate to individuals.

We may collect information about you, which may include demographic information and other attributes about you, from our partners, service providers, and affiliated businesses to provide our services, along with certain related products and services such as property financing, title insurance, escrow services, property builder partnership programs, real estate agent partnership programs, and access to other potential purchasers or brokers, or to listing agents who may be able to help with your property sale.

Information we gather about you from our partners, service providers, and affiliated businesses may include:

  • MLS information about your property, your potential, past or current listings or the properties you are interested in listing, buying or selling;
  • Prequalification letters from financial institutions;
  • Construction or purchase contracts;
  • Verification of your identification and a risk score about you before allowing you smart-lock-enabled entry into a property;
  • Information related to the completion of the construction of your new property (if you are working with a propertybuilder);
  • Information about the condition of, and repairs to, your property and property;
  • Information related to your property listing purchase, sale, moving dates, and financing in connection with helping us facilitate “trade-in” deals;
  • Information about whether you may need homeowners’ insurance; and
  • Information about how you engaged with a Klaviss advertisement or social media posts.

Much of the information necessary to help you list, buy or sell your property is available from public government sources. We sometimes collect information from these sources so that you do not have to spend time looking for and aggregating it for us. For example, we may collect the following information about you and your property from public sources:

  • Tax assessments of your property;
  • The school district and public transportation available near your property;
  • Information contained on the deed to your property, such as name, address, liens, encumbrances, and title;
  • Sale prices of properties similar to your property;
  • The number of bedrooms and bathrooms in your property;
  • Whether your property has access to features like a beach, boat dock, or parking garage;
  • Whether your property is in an earthquake or flood zone or has any other condition that would affect its market value;
  • Permits issued for remodels and additions;
  • The finished and unfinished square footage of your property; and
  • The year in which your property was built.

Information We Collect as You Use Our Services

Along with the information you give us directly, we collect a variety of information automatically as you use Klaviss services.

Activity Information

We collect information about how you use Klaviss. These include things like your property search history, properties you view, purchase activity, what you’ve clicked on, other uses of our features, and the amount of time you spend looking at different parts of our websites. When you call or text Klaviss or a real estate professional using our platform, we collect data about your call or text, including the date and time of the call or text, your phone number, and the content of the call or text.

We may record phone or video calls with you for quality assurance purposes. Our customer service team members also enter certain information you provide into our customer service databases to ensure continuity and consistency throughout your experience with Klaviss.

Device Information

Like other websites and apps, we collect data about the browsers and devices you use to access Klaviss. The data we collect includes a browser or device model and settings, operating system, unique identifiers, and the version of the app you’re using. We also collect data about how your browsers and devices interact with our services, including IP address, crash reports, system activity, and the date, time, and the URL of the site you visited before Klaviss.

You can control our collection of certain data, such as your mobile device model or the language your mobile device uses, by adjusting the privacy and security settings on your mobile device.

Without limiting anything in this privacy policy, we may collect data from your devices including the following:

  • Device attributes such as the operating system, hardware, and software versions, battery level, signal strength, bandwidth, available storage space, browser type, app and file names and types, and plugins;
  • Information about operations and behaviors performed on the device, such as mouse movements (which can help distinguish humans from bots) or whether a window is in the foreground or background;
  • Identifiers unique to you, your device, or your accounts (s), such as device IDs, advertising IDs, and other similar static ID numbers such as those from apps or accounts you use;
  • Information you allow us to receive through device settings you turn on, such as access to your GPS location;
  • Network and connection information such as the name of your mobile operator or ISP, language, time zone, mobile phone number, and IP address; and
  • Data from cookies, tags, pixels, web beacons, and log files stored on your device, including cookie IDs, page views, how often you visit our website or mobile application and links you click on.

We generally use this information for your convenience and to improve our services. For example, we may use it to (i) remember your information so that you do not have to re-enter it; (ii) provide you with customized content and information, including advertising; (iii) monitor the effectiveness of our services; (iv) monitor aggregate metrics such as the total number of visitors, traffic, and usage patterns; and (v) diagnose or fix technology problems.

Location Information

If you enable location services on your mobile device, Klaviss collects the location of your device. We use that information to provide you with location-based information and ads, like properties and real estate professionals in your area, and to offer location-based services. If you don’t want to use these features, you can turn off location services on your device.

We also collect location information for similar purposes from your browser if you enable it. You can disable access through your browser settings.

Cookies, Pixel Tags, and Other Tracking Technologies

Our partners and we use various tools to collect data when you visit our sites and apps, including cookies, pixel tags, and other similar technologies. Cookies are bits of electronic data that can be transferred to your computer or other devices to identify your browser.

When you use Klaviss, we and our partners may use cookies and other tools to gather information about how you view and use our services and content, and to connect your activity with other data we store about you. The use of cookies helps us serve you better by understanding what you’re interested in, tracking trends, measuring the effectiveness of ads, saving your preferences, and storing information you may want to retrieve regularly, such as your favorite properties. We also allow specific, approved partners to collect data from your browser or device for advertising and measurement purposes using their cookies or similar tools.

You can disable cookies altogether by adjusting the settings on your browser. However, if you choose to disable some or all cookies, many parts of our services may no longer work.

In addition, if you give your email address to us, we may use a scrambled, unreadable form (called a “hashed” version) of your email address to deliver tailored ads to you on Klaviss or other websites, including via Facebook’s Custom Audience Feature or other similar tools.

Social Networks

If you use social media logins (like Google and Facebook) to log in to Klaviss, we may access your public social media profile information. You can always limit this sharing using your social media service settings.

Inferences

To improve our services and make them more useful to you, we use data about your activity to understand and infer your preferences.

Commercial Information

We collect information about the products and services you purchase or consider purchasing from us. This includes products for professionals, such as our advertising products, as well as consumer services.

Why Klaviss Uses Your Information

Completing Your Transactions

When you use Klaviss to complete real estate transactions, like listing, buying or selling your property, we use your personal information to verify your identity and process and complete your transaction.

Providing and Improving Our Services

We use your information to provide our services to you. These include things like returning property search results. We also use your information to improve our existing services and develop new ones.

Communicating with You and Connecting You with Others

We use the contact information you provide us with, like your phone number and email address, to communicate with you about our services. These include things like responding to comments, questions, and requests you send us. It also includes notifying you of transaction or service updates and changes. We may also inform you about our services, offers, promotions, news, and other updates we think may be of interest to you.

If you ask us to, we also use your information to connect you to real estate professionals, like when you want to contact an agent to discuss a property you find for sale on our platform.

Personalizing Your Experience

We use the information we collect about you and your activity on our services to personalize the services we offer. We also use it to show advertising, content, or features that we think you might like. This includes things like customized search results that match your preferences and prior search criteria and, if you ask us to, connecting you to a real estate professional best suited to help you.

If we know you’re working with a particular real estate agent, we may share information about your saved properties and searches with that agent to let them serve you more effectively. You control what we share with real estate professionals you find on our platform.

To Learn About the Home Property You May Want to List, Sell or Buy

If you are interested in selling, we use the information you provide us with about the property, including photos and videos, to help us provide our services to you and others. If you are interested in listing, buying a property, we may consider the information you provide us about the property you are interested in listing, buying; including property profiles that you have indicated your interest in, to try to match you with properties you might want to purchase.

To Keep You, Your Information, and Our Properties Safe

Klaviss cares about your safety. We use the monitoring and identity verification technologies described above to help keep you safe when you visit a property and prevent property damage and fraud.

To Advertise Our Services

We may use information collected about you to provide you with relevant information about additional services that Klaviss or our affiliated companies offer, such as our trade-in program, property financing, and title insurance services. Specifically, we use information about how you interact with our website and mobile application, combined with information you provide us and information we collect from other sources, to serve you relevant advertising.

To-Do Market Research

We are constantly striving to improve our customer experience. We conduct research into all aspects of the property lisitng, buying and selling process and try to identify ways to make it better. Sometimes we use partner companies to conduct surveys of willing participants who offer suggestions as to how we might improve our services. We also aggregate and analyze consumer information that we collect on our website, mobile applications, and from conversations with our customer service representatives to identify trends that inform us how we change and grow.

To Support Information Security and Debugging

We may use information about you and your use of our services to detect security incidents, protect against malicious, fraudulent, or illegal activity, and improve the security of our services. We may also use this information to debug our services to identify and repair errors that impair existing intended functionality.

In Connection with a Dispute

We may use personal information to prosecute or defend against claims in court and other dispute resolution forums.

Other Uses of Your Information

We also use your data to detect, investigate, and prevent fraudulent transactions and other illegal activities and to protect the rights and property of Klaviss, its customers, and others.

Occasionally, there may be a reason we’d like to use your information in a way that isn’t described here.

Sharing Your Information

We understand that sharing information with third parties is a big responsibility. We’re committed to sharing information only when needed for a legitimate business or legal purpose, and then only with recipients who will protect it.

Information You Ask Us to Share

We share information when you ask us to share it. For example, if you choose to contact a real estate agent, mortgage lender, investor, builder, property manager, or other real estate pros through our platform, we will send them your name and contact information.

Without limiting anything in this privacy policy, some additional examples of these situations include:

  • Agent partnerships. Klaviss works with both consumers and real estate agents. We may share your information with our agent partners to pair you with an agent who can help you through the property lisitng, buying or selling process.
  • Builder partnerships. Klaviss partners with propertybuilders to provide buyers who are purchasing new properties from these builders with the opportunity to request offers from Klaviss for their current properties. When working with a property builder, we may share your information with them.
  • Financing providers. If and to the extent you authorize us to do so, we may share your information with property financing providers.
  • Potential property buyers. We may work with trusted institutional property buyers to try to find a purchaser for the property.
  • Escrow, closing attorney, title, homeowners’ insurance. If you need escrow, closing attorney, title insurance services, or propertyowner’s insurance services, we may share your information with escrow, closing attorney, title, and propertyowner’s insurance companies.
  • Renovation companies. If you need renovation services, or to help us evaluate or repair properties we may acquire, we may share your information with renovation and construction companies.
  • Other partners with whom you ask us to share your information.
Service Providers and Business Partners

When Klaviss hires a service provider to help operate our business, we may need to give them access to information to provide their service. We allow them to use the information only to perform the service we’ve asked them to perform. We vet all service providers carefully.

When Klaviss partners with other businesses to offer products and services to you, we may share information with those partners only as needed to provide those products and services and only subject to the terms of this privacy policy.

With Our Affiliated Companies

We may share your information between our affiliated companies to the extent allowed by law.

Legal and Compliance Transfers

When Klaviss needs to share data to satisfy a legal or regulatory requirement, including responding to a subpoena or other lawful government request for data, we will share information only as necessary to comply with that requirement. We may also share information if needed to enforce our legal rights, detect or prevent fraud or security concerns, and protect public safety.

If Klaviss is involved in a merger, acquisition, or any form of transfer or sale of some or all of its business, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, we may share your information in connection with that transaction.

Without limiting the foregoing, Klaviss may also disclose your data in the good faith belief that such action is necessary to comply with a legal obligation, to protect and defend the rights or property of Klaviss, to prevent or investigate possible wrongdoing in connection with any service provided by Klaviss, to protect the personal safety of users of any services provided by Klaviss or the public and/or to protect against legal liability.

Public and Deidentified Data

We may share information collected from public sources or that you choose to share publicly (such as public reviews and property facts) with third parties. We may also share aggregated and/or de-identified information that cannot reasonably be used to identify you.

Sale of Personal Information

Klaviss is not a data broker. However, Klaviss allows certain companies to place tracking technologies like cookies and pixels on our sites, which allows those companies to receive information about your activity on Klaviss that is associated with your browser or device. Companies may use that data to serve more relevant ads on our sites or others. Under some state laws, sharing data for online advertising like this may be considered a “sale” of information.

Additionally, in some circumstances, we share your information with third parties not owned by or co-branded with Klaviss, specifically:

  • Social media. If you use our Services, we may provide information about that use to social media networks who will use it to better target advertising.
  • Third Party property buyers. We may share your information with institutional property buyers to try to find a purchaser for the property.
  • Property insurance agencies. If you need homeowners insurance, we may share your information with homeowners insurance agencies and those agencies may reach out to offer you a quote.
  • Vendor due diligence. If you are an individual or business that wishes to provide services to Klaviss, we may share your information with a due diligence service to perform vendor due diligence. The due diligence provider may use this information to inform and further refine its risk analysis tools.

Third Party Advertisers

Klaviss’s third-party ad servers, ad network providers, and third-party advertisers provide ad content that appears on Klaviss. To measure how effective those ads are and to make them more relevant, ad providers may use their tracking technologies to collect your information. These are used to record users’ activity, such as the pages visited, and to learn what types of information are of most interest to the users.

Managing Communications Preferences

Email Subscriptions

Klaviss may send you an email for a variety of reasons. For example, when you use our transaction services, we’ll send you status updates and other information about your transaction. If you have an account with Klaviss, you can select your preferences through your account settings. Also, you can manage the types of emails you receive by following the instructions included in each email we send you. Even if you unsubscribe from some email subscriptions, we may still need to email you with important transactional or other non-advertising information.

Calls and Texts

Some of our services allow you to provide your phone number to us. If you give us your number, we may call or text you. We will contact you through these methods only following applicable legal requirements, and you can always opt out of further calls or texts.

Protecting Your Information

We understand that no matter how we collect your information, we have a responsibility to protect it. We build security into our products and features from the ground up to help protect data from unauthorized access, disclosure, alteration, and destruction.

We’re always looking for threats and take reasonable steps to respond to those threats, protecting the information users share with us. Of course, no method of Internet transmission or data storage can provide guaranteed protection to your information. If anything should ever happen to your information, we’ll let you know as soon as we can and try our best to make it right.

Klaviss is based in the United States, and the information we collect is governed primarily by U.S. law. Where we are subject to the privacy laws of other countries, we comply with those requirements. If you access or use our services or provide information to us, your information will be processed and stored in the United States, where you may not have the same rights and protections as you do under your local law.

Safeguards

We use commercially reasonable physical, electronic, administrative, and procedural safeguards to preserve the integrity, confidentiality, and security of all personal information collected through our services. However, no security measure, system, or control is infallible. Therefore, like all businesses, we cannot guarantee that our services are invulnerable to attack or misuse.

Your Role

You have a major role in the security and privacy of your information. For example, you should not provide us with personal information that we do not request. Additionally, you are responsible for controlling access to any personal computing device through which your information may be stored or accessed. You are also responsible for safeguarding any passwords or other login credentials that may be used to access your information, including in any Klaviss environment. We recommend that you log out of any account when you are done using it.

Third Parties

Please remember to review the privacy settings and security policies of third-party sites and services that you use, such as social networks. We are not responsible for the privacy or security measures of any third party.

Incident Response

If the security of any personal information under our control is compromised, we will take reasonable steps to investigate and mitigate the situation, including, when appropriate, notifying those individuals whose information may have been compromised and taking other steps following applicable laws and regulations.

Applicability of This Policy

This policy applies to every service of ours that links to it. Our apps and services may link to other companies’ websites. Some features may also involve the sharing of your information with third party websites. These third party websites may collect information about users on those websites. Klaviss doesn’t control those sites, and this privacy policy does not apply to these external websites and third parties.

Legal Disclosures

In this section, we’ve provided some legally required disclosures under state privacy laws. There shouldn’t be anything surprising in this section, and we’ve tried to explain our privacy practices in plain English throughout the rest of the policy.

Under the California Consumer Privacy Act or CCPA, California residents have certain rights regarding their data, including:

  • The right to know the categories of personal information we’ve collected and the categories of sources from which we got the information;
  • The right to know the business purposes for sharing personal information;
  • The right to know the categories of third parties with whom we’ve shared personal information; and
  • The right to access the specific pieces of personal information we’ve collected and the right to delete your information.
How to Make a California Consumer Privacy Act Request

You may request to know, delete, or opt-out of sales under the CCPA by emailing us at hello@klaviss.com. Only you or a duly authorized agent may make a CCPA request on your behalf. You have the right to make a free request twice during any twelve months. The request must:

  • Provide sufficient information for us to reasonably verify that you are the person, or an authorized representative of the person, about whom we collected the personal information; and
  • Describe your request with sufficient detail for us to properly understand, evaluate, and respond to it.

Submitting a request does not require you to create an account with us. However, for your safety and the safety of your information, we cannot fulfill a request to provide or delete personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you or an individual for whom you are an authorized agent. We may require additional verification before deleting or disclosing particularly sensitive information. We will only use the verification information you provide to verify your identity or authority to make the request.

We do not charge you a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

California residents also have the right to not be discriminated against if they choose to exercise their privacy rights. We will not discriminate against you for exercising your rights under the CCPA. Unless permitted by law, we will not:

  • Deny you goods or services;
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
  • Provide you with a different level of quality of goods or services; or
  • Suggest that you might receive a different price or rate for goods or services or a different level or quality of goods or services.

Changes to This Policy

We review our privacy practices to make sure they comply with this policy. Sometimes, we’ll need to update the policy to reflect changes in our products, technology, and uses of data. We won’t change the policy in a way that reduces your rights or significantly changes the way we use or share data without telling you ahead of time and giving you a chance to stop using our services if you want.
